By accessing or using Balanced Mind EMDR ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Important Medical Disclaimer

The Service provides EMDR-inspired exercises and journaling tools. While EMDR is an evidence-based therapy, using this application is not equivalent to receiving EMDR therapy from a trained and licensed professional.

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement. If you are using the Service on behalf of a minor, you are responsible for their use of the Service.

4. Account Responsibilities

• You are responsible for maintaining the confidentiality of your account credentials
• You must provide accurate information when creating your account
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account

5. Subscription and Payment

Free Tier

We offer a free tier with limited features. No credit card is required for the free tier.

Paid Subscriptions

• Paid subscriptions are billed monthly
• All paid plans include a 7-day free trial
• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• We do not provide refunds for partial months of service

Price Changes

We reserve the right to change subscription prices. You will be notified at least 30 days in advance of any price changes, and changes will not affect your current billing period.

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service or its servers
• Share your account with others or allow multiple users to use a single account
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to harm or harass others

7. Intellectual Property

The Service, including its design, features, and content, is owned by Balanced Mind EMDR and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

You retain ownership of any content you create within the Service (such as journal entries). You grant us a limited license to store and process this content solely to provide the Service to you.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALANCED MIND EMDR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims arising from or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

10. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may terminate your account at any time by deleting it through the Settings page. Upon termination, your right to use the Service will immediately cease.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through a notice in the application. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
